Under California law, sexual battery, which is commonly called sexual assault, can occur under several different circumstances:

It can be the touching of an intimate part of another person while that person is unlawfully restrained by the accused or an accomplice. The touching must be against the will of the person touched. Sexual battery can also occur when the victim is disabled or medically incapacitated and institutionalized for medical treatment, or where the person is unconscious of the nature of the act because the perpetrator fraudulently represented that the touching served a professional purpose. In all of these instances, the touching must be for the purpose of sexual gratification.

Sexual battery can be any touching of an intimate part of another person against that person’s will and for the purpose of sexual gratification or arousal. Touching is any physical contact, including though clothing.

Sexually battery can be either a misdemeanor or felony.  A misdemeanor is punishable by up to a year in a county jail and a fine of up to $2,000. If charged as a felony, sexual battery can be punished by up to four years in prison and a fine of up to $10,000.
