Reckless driving occurs when you drive a vehicle either on a road or a parking lot “in willful or wanton disregard for the safety of persons or property.” This is more than just negligent driving. This requires an intent to do something and a reckless disregard for the consequences. If a police officer stops you for reckless driving, the officer may arrest you and impound your vehicle.
Reckless driving is a violation of Vehicle Code 23103. A conviction for reckless driving where no one other than the driver is injured can result in 5 to 90 days in jail and a fine of $145 to $1,000. If your driving causes an injury to someone else, then the punishment increases to 30 days up to 6 months in jail and a fine of up to $1,000. If the other person sustains serious injuries such as loss of consciousness, broken bones, or paralysis, the punishment can increase even further. Other circumstances, such as filming the driving for commercial purposes or endangering a child, can change the crime from an infraction to a misdemeanor with harsher punishments.
